(3) Part III Allegation of allegations of misconduct or misbehavior -
District Magistrate, Ara, Bhojpur, through his letter no. 2789/conf , dated - 24. 09.2017 and 2780/ conf dated - 24.09.2017, has accused Shri Rahul, B.A.S.,Civil list number 913/2011, District Program Officer (ICDS), Bhojpur, of misusing the position, blackmailing and serious corruption charge
2. During a mobile conversation with Mrs. Madhurima Prasad, Child Development Project Officer, Gahani Mojpuri during her leave period, you demanded illegal amount of money and when she refused to give it, she was pressurized to do wrong and threatened that a action would be taken against her for violating the order and she would be harassed. It was also said by you that Smt. Rita Kumari, current Child Development Project Officer, Jagdishpur, Bhojpur, had also violated the order, due to which she is suffering the consequences.
This conduct of yours is an example of misusing your position for the purpose of serious corruption, instigating your subordinate officers to indulge in corruption and blackmailing them to recover illegal money. You are guilty of misusing your position for the purpose of serious corruption.
2. Demanding illegal amount by a government employee/official is in itself a serious act of corruption and contrary to the conduct of a government servant. Also, as a District Program Officer, there is no natural official relationship between between you and the concerned Child Development Project Officer regarding the the transaction of money , nor did you give any prior information in this regard to your controlling authority so that the the allegation of the demanding money for the purpose of serious corruption and harassment of his subordinate officer inducing to comm t corruption by blackmailing seems to be proved.
3. Since there is no official connection of money transaction between you as District Program Officer and Child Development Project Officer, your demand for money from Child Development Project Officer is in contravention of and Rule- 3 (i)(ii) (iii) and Rule. -17(5)(i) (a) of the Government Servant Conduct Rules, 1976 and also because you did not give any prior information to your controlling authority regarding this concern, this conduct of yours is also a violation of Rule 17(6) of the the Government Servant Conduct Rules, 1976.
4. In the above situation, it is proved that you are guilty under Rule- 3 (i)(ii) (iii) and Rule. -17(5)(i) (a) and 17(6) of Government Servant Coming Rules, 1978. .
